Using the Card
Eat and Play Card (the Card/we) cannot be used in conjunction with other offers, discounts, specials (which may include prix fixe, happy hour or lunch specials) unless at the discretion of the Participating Merchant. The Card applies to take-out and alcoholic beverages at the Merchant’s discretion. The Card does not apply to gratuities or taxes. Please ensure your gratuities reflect the bill before discounts have been applied. The Card is non-transferable and holds no cash value. Lost cards in any format are non-refundable. We reserve the right to change prices at any time.
Merchant Access
The Card is only valid at participating merchants in the city and locations specified. Participating Merchants may have their own “Terms & Conditions,” and in some cases, minor restrictions, which will also apply to your use of the Card. Admission to participating merchants is subject to availability. On some occasions Merchants may be closed due to private functions or otherwise and beyond our control. We cannot be held responsible for weather or other conditions or circumstances that may affect use of the Card. We will do our best to keep our list of Participating Merchants up to date on our website or mobile app, but, have less control over printed materials. Participating merchants may be removed from the program without prior notice. Always check www.eatandplaycard.com and Merchant websites directly for their most up to date information.
Liability
We are not an agent of the Participating Merchants and cannot be held liable for any illnesses, bodily injury, loss of enjoyment, financial loss or property damage resulting from any accident, event or occurrence resulting from the use of the Card or resulting from the use of the premises or property of the Participating Merchants. Card holders and members of their group expressly agree that use of the Card and its Participating Merchants’ services or offerings are at their own risk and in no event shall Eat and Play Card or its affiliates, employees, agents, contractors or licensees be liable for any damages resulting from the use of the Card. Any grievances or actions with Eat and Play Card must be interpreted and filed in accordance with the laws of the Province of Ontario and of Canada and accordingly applied therein.
